Terms of Service

1. Acceptance of Terms

By accessing, browsing, subscribing to, or using the SportInvestNow platform, websites, software applications, educational materials, or decision-support tools (collectively, the "Service"), or by registering as a Founding Member, you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations in your jurisdiction.

If you do not accept these Terms, you are prohibited from using the Service. We reserve the right to refuse or terminate service to any individual or entity at our sole discretion.

2. Nature of the Service

SportInvestNow is an English-language guided self-service software-as-a-service (SaaS) platform providing sports trading education, analytical workflows, portfolio simulation methodology, and manual/semi-automated decision-support tools.

CRITICAL NOTICE: SportInvestNow does not operate as a bookmaker, betting shop, betting exchange, financial adviser, broker, custodian of client funds, or fund manager. We do not place bets on behalf of users, nor do we manage funds or accept capital for trading or betting purposes.

The Service is designed to allow individuals to reconstruct sports strategies, test historical parameters under simulation models, and structure sports assets inside custom portfolios ("Sportfolio"). Individual execution remains manual and fully client-controlled within the client's personal third-party accounts (e.g., Betfair Exchange).

3. Eligibility and Compliance

To subscribe to or use the Service, you represent and warrant that:

• You are at least 18 years old or have reached the legal age required for sports-related modeling and exchange activities in your jurisdiction.
• Your use of sports analytics, simulation tools, and betting exchange APIs is fully legal in your jurisdiction.
• You are not a citizen of, resident of, or located in any country prohibited from using the service, and you are not restricted by local laws or self-exclusion panels.
• You will access and use the Service strictly in compliance with all relevant laws, licensing policies, and responsible gambling frameworks.

4. Subscription and Founding Member Plans

Subject to acceptance and approval of your application, you may be offered access to the Service via a Founding Member Plan (Starter, Pro, or Advanced).

Fees are billed on a recurring monthly subscription basis. All fees are in Euros (€) unless specified otherwise. We reserve the right to modify subscription fees or plan configurations. However, approved Founding Members shall receive a 12-month flat price lock relative to their approved registration plan, subject to continued compliance.

5. User Execution and Account Responsibility

You are sole owner of and responsible for your third-party account credentials (such as Betfair API keys, login parameters, and balances). SportInvestNow only provides analytical telemetry and configuration guidelines.

During the Founding Member MVP phase, all live actions or matching trades must be initiated and executed manually by the client. SportInvestNow is not responsible for any input errors, latency, network errors, or manual execution failures originating on the client's hardware or third-party exchange platform.

6. Limitation of Liability and No Guarantees

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SPORTINVESTNOW AND ITS AFFILIATES, OFFICERS, OR DATA PROVIDERS DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ACCURATE, OR ERROR-FREE.

UNDER NO CIRCUMSTANCES SHALL SPORTINVESTNOW BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, SECULAR, OR PUNITIVE LOSSES OR DAMAGES, INCLUDING BUT NOT LIMITED TO BANKRUPTCY, TRADING LOSSES, CAPITAL DRAWDOWNS, AND PERSONAL OR FINANCIAL DAMAGES SUFFERED AS A RESULT OF SPORTFOLIO MODELS.

PAST PERFORMANCE, BACKTEST SIMULATIONS, AND STRATEGY RECONSTRUCTIONS DISPLAYED ON THIS SERVICE ARE COGNITIVE EXPERIMENTS ONLY AND DO NOT REPRESENT OUTCOME ASSURANCES OR AN INDICATION OF FUTURE TARGET ESTIMATES.

7. Governing Law and Jurisdiction

These Terms and any non-contractual obligations or claims arising out of the Service shall be governed by and construed in accordance with English law. Any dispute or action arising from or in connection with the Service shall be subject to the exclusive jurisdiction of the Courts of England and Wales.
